[Update] DGFT Issues GAICT Forms for Intra-Company Transfer of SCOMET Items

On 17th March, the Directorate General of Foreign Trade (DGFT), vide Public Notice No. 65/2015-20 issued proformae of application form (ANF 2 O (b)) and end use certificate (EUC) for implementation of Global Authorisation for Intra-Company Transfers (GAICT) of SCOMET items/software/technology under Para 2.79F of the Handbook of Procedures (HBP) of the Foreign Trade Policy (FTP) 2015-20.

P.N. 65, which applies to export/re-export of dual use SCOMET items/software/technology between Indian subsidiary to its foreign parent company and/or to subsidiaries of foreign parent company, will significantly improve ease of doing business for companies which export dual use items/software/technology.

While GAICT had been notified as far back as July 2019 (vide Public Notice 20/2015-20), the relevant forms/guidelines for implementing GAICT (namely ANF 2 O(b), ANF 2 O(c) and EUC) had not been issued. In February, 2020 NASSCOM had made a representation to the DGFT requesting that the forms for operationalising GAICT be issued at the earliest.

With P.N. 65, we expect that eligible companies will soon start filing applications to avail of GAICT for intra-company transfers of SCOMET items/goods/technology which is valid for three years from the date of issue of GAICT.
