Update: NASSCOM participates in the first meeting of Grievance Redressal Committee for GST issues

The Goods and Services Tax (GST) Council, in its 38th meeting, approved constitution of “Grievance Redressal Committee” at Zonal/ State level to tackle grievances of taxpayers on GST related issued of specific/ general nature.

Accordingly, a Grievance Redressal Committee has been formed in the State of Karnataka comprising of officials from Goods & Services Tax Network (GSTN), Office of Principal Chief Commissioner of Central Tax along with various industry associations including NASSCOM. The mandate of the Committee is to:

  1. Examine and resolve all grievances and issues being faced by taxpayers, including procedural difficulties and IT related issues pertaining to GST, both of specific and general nature;
  2. Refer any issue requiring a change in Act/ Rules/ Notification/ Form/ Circulars/ Instruction, etc., to the GST Council Secretariat and the relevant Policy Wing of Central Board of Indirect Taxes and Customs (CBIC);
  3. Refer any matter related to IT issue pertaining to GST Portal to GSTN.

The committee meetings will be co-chaired by Mr. D.P. Nagendra Kumar, Principal Chief Commissioner of Central Tax and Mr. M.S Srikar, Commissioner of Commercial Taxes.

The first meeting of the committee was held on February 18, 2020 wherein NASSCOM highlighted some of the key issues being faced by Information Technology – Business Process Management (IT-BPM) industry. One of the most prominent issue is the interpretation of IT enabled Services (ITeS) as Intermediary, pursuant to an Advance Ruling by Maharashtra Appellate Authority for Advance Ruling, which resulted in denying export status to back-office operations set-up in India. The Committee recognised it to be a concern and agreed to work with NASSCOM and other stakeholders to arrive at a feasible solution.

NASSCOM also highlighted the difficulties faced by member companies in complying with mandatory implementation of e-invoicing system from April 1, 2020 for certain taxpayers due to change and updation of e-invoicing schema and template. While highlighting the problems, NASSCOM also acknowledged the benefits of implementation of e-invoicing. However, for smooth implementation of the system, we requested GSTN to provide more time to the Industry to plan and effect changes for smooth rollout of this landmark change. We will work with the GSTN and GST Council to address the issue.

We welcome constitution of the Grievance Redressal Committee by the Government. This will help in resolving GST issues being faced at the central as well as state level. We look forward to working with the Government to ensure that GST policies are in line with the needs of the industry.
